What is the European Commission reviewing about nicotine pouches in Europe?

The European Commission is reviewing the EU Tobacco Products Directive and Tobacco Advertising Directive. These laws control how tobacco and related products are sold, presented and advertised across the European Union.

Nicotine pouches are currently not covered by one harmonised EU-wide regulatory framework. Different countries have therefore taken different approaches. Some countries permit nicotine pouches, while others have introduced restrictions, nicotine limits or bans.

The European Commission has identified new nicotine products, including nicotine pouches, as part of the regulatory gap it wants to address through future EU nicotine pouch legislation.

That means nicotine pouches are now part of a wider EU discussion about future product regulation.

For adult consumers, the important question is simple:

Will future EU rules respect adult consumer choice, or will they make nicotine pouches more expensive and more restricted?

New EU nicotine pouch taxes are already on the table

The threat of higher prices is not just speculation.

On 16 July 2025, the European Commission proposed a revision of the Tobacco Taxation Directive. Under this proposal, nicotine pouches would be brought under EU minimum excise-tax rules for the first time.

This would create minimum tax levels for nicotine pouches across the EU. Individual countries would also remain free to apply even higher taxes.

Under the proposal, nicotine pouches would face EU minimum excise duties of:

  • From 1 January 2030: at least 25% of the retail selling price including taxes, or €71.50 per kilogram.
  • From 1 January 2032: at least 50% of the retail selling price including taxes, or €143 per kilogram.

For many consumers, this represents the most significant proposed change to nicotine pouch taxation in Europe in recent years.

The proposal is not final law yet. However, it clearly shows that higher taxation of nicotine pouches is already being actively pursued at EU level.

For adult consumers, the consequence could be straightforward: higher prices for the nicotine pouches they buy today.

When the cost of living is already increasing across Europe, consumers deserve to be heard before politicians add new taxes to products used by adults.

Could future EU nicotine pouch regulations affect flavours and nicotine strengths?

No final EU-wide flavour ban or nicotine-strength limit for nicotine pouches has been adopted through this consultation.

However, that does not mean product choice is safe from future restrictions.

Across Europe, nicotine pouches are already being treated differently from country to country. Some national authorities have introduced strict rules, maximum nicotine levels or complete bans. Public health groups and policymakers are also increasingly calling for tighter restrictions on flavoured nicotine products.

As the European Commission prepares future EU-wide rules, questions about flavours, nicotine strength, packaging, advertising and product availability could all become part of the discussion.

This matters because adult consumers do not all choose the same products for the same reasons. Flavour preference, pouch strength and product availability can be important parts of why an adult consumer chooses one nicotine product over another.

Reasonable protections for minors are important. Nicotine products should only be sold to adults and marketed responsibly.

But protecting minors should not mean ignoring adult consumers or removing their choices without listening to them first.

Why should adult nicotine pouch consumers in Europe care?

Regulatory decisions are often shaped by the groups that take the time to respond.

Public health organisations, government agencies, campaign groups and industry associations will all make their positions known.

Adult consumers should not be left out of that conversation.

Future EU rules could affect:

  • How much nicotine pouches cost.
  • Which flavours are available.
  • Which nicotine strengths can be sold.
  • Whether certain nicotine pouches remain available in your country.
  • How nicotine pouches can be packaged, advertised or purchased.

If adult consumers remain silent, decision-makers may only hear from those calling for higher taxes, stricter limits and fewer product choices.

Once new EU rules are introduced, they can be difficult to change.

That is why it is important to speak up now, before final decisions are made.

Why nicotine pouches are different from traditional tobacco products

Nicotine pouches are often called white snus or tobacco-free snus by consumers. However, they are not the same as traditional tobacco snus.

Nicotine pouches contain nicotine but no tobacco. They are placed under the lip, but they do not contain tobacco leaf.

This difference is important when new rules are being considered. Nicotine pouches should be regulated based on accurate information about what they are, how adults use them and how they differ from traditional tobacco products.

Adult consumers deserve rules that are proportionate, reasonable and based on evidence.
